1. Your Relationship With Us

Welcome to PicFix (the "App", "Platform", or "Services"). These Terms of Service (these "Terms") govern the relationship and serve as a legally binding agreement between you ("you" or "User") and AtlasV Global Pte. Ltd. ("we", "us", or "our") regarding your access to and use of the App and its related artificial intelligence (AI) photo editing services.

By downloading, installing, registering with, accessing, or using the App, you confirm that you can form a binding contract with us, that you accept these Terms, and that you agree to comply with them. Your access to and use of our Services are also subject to our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

Age Requirement: The Services are only intended for individuals 13 years old and older. If you are under 18 years old (or the applicable age of majority in your jurisdiction), you may only access or use the Services with the explicit consent and supervision of your parent or legal guardian.

2. Description of the Service

PicFix provides an AI-powered image-to-image generation and editing service. Users can upload a photograph, provide text prompts (instructions), or upload reference images (collectively, "Inputs"), and our AI models will process these Inputs to return a refined, edited, or stylized version of the photograph ("Output").

We reserve the right to add, modify, or remove features of the Services at any time without prior notice.

3. Account Registration and Security

While you may use certain basic functions of PicFix without registration, accessing premium features or saving your preferences may require you to create an account (e.g., via Google Sign-In).

If you create an account, you must provide true, complete, and accurate information. You are solely responsible for maintaining the security and confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@aipicfix.app if you suspect any unauthorized use of your account. We shall not be liable for any losses incurred by you as a result of unauthorized access to your account.

4. User Content

4.1. Ownership and Licensing
You may upload, transmit, and submit photos, reference images, and text prompts ("Inputs") to receive generated edited images ("Outputs"). Inputs and Outputs are collectively referred to as "User Content".

4.2. Nature of AI Generation
You understand and agree that Outputs are generated by Artificial Intelligence. We do not guarantee that Outputs will always meet your expectations, be completely unique, or flawlessly depict what you are looking for. Because of the nature of machine learning, similar Inputs from different users may result in similar or identical Outputs. You may not use the App to mislead any third party into believing that the Output was produced solely by a human.

5. ZERO TOLERANCE FOR NSFW AND OBJECTIONABLE CONTENT

We maintain a strict Zero Tolerance Policy regarding Not Safe For Work (NSFW), sexually explicit, and objectionable content. The AI models powering PicFix are designed for creative, aesthetic, and safe photo enhancements.

As a strict condition of your use of the Services, YOU EXPLICITLY AGREE THAT YOU WILL NOT:

7. In-App Purchases, Subscriptions, and Refunds

Some features of the App are provided free of charge, while premium features (such as faster processing, advanced AI tools, or ad removal) require an active subscription or in-app purchase ("Premium Services").

7.1. Billing by Google Play
Premium Services are offered on a subscription basis (e.g., weekly, monthly, annually) and are billed directly by the Google Play Store. By completing an in-app purchase, you agree to Google Play's Terms of Service and payment policies. We do not directly collect or process your credit card information.

7.2. Auto-Renewal
Subscriptions automatically renew unless auto-renew is turned off or canceled at least 24 hours before the end of the current billing period. Your Google Play account will be charged for renewal within 24 hours prior to the end of the current period.

7.3. Cancellation and Refunds
You can manage and cancel your subscriptions at any time by going to your Google Play Account Settings. Because purchases are processed by Google Play, we cannot directly issue refunds. All billing and refund inquiries must be directed to Google Play customer support, and refunds will be governed by Google Play's refund policies.

8. Intellectual Property Rights

PicFix and all related trademarks, logos, designs, source code, AI models, and software are the exclusive property of us and its licensors. These Terms only grant you a limited, non-exclusive, revocable license to use the App for its intended purposes. You are not granted any intellectual property rights in the App itself.

9. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, officers, directors, employees, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  1. your violation of these Terms (especially Section 5 regarding NSFW content);
  2. your User Content infringing the intellectual property or privacy rights of any third party; or
  3. your misuse of the Services.

10. Exclusion of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, TIMELY, OR SECURE, NOR DO WE GUARANTEE THE ACCURACY OR QUALITY OF ANY AI-GENERATED OUTPUT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL US OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50.00), WHICHEVER IS GREATER.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease, and you must delete the App from your device. Sections regarding Intellectual Property, Indemnification, Disclaimers, and Limitation of Liability shall survive termination.

13. Changes to These Terms

We may update these Terms from time to time to reflect technological or legal changes. We will notify you of material changes by updating the "Last Updated" date at the top of this document or via an in-app notification. Your continued use of the App after such updates constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the competent courts located in Singapore.
